Resumen
El objetivo de este trabajo es analizar críticamente la Ley Antiterrorista chilena a la luz de los desafíos contemporáneos de la seguridad, identificando sus avances, limitaciones y riesgos. Aunque las reformas aprobadas en 2024 representan un avance, persisten ambigüedades en la definición del terrorismo, así como un enfoque más reactivo más que preventivo, y la falta de claridad en el rol de las fuerzas armadas y policiales. Asimismo, la ley no aborda de manera suficiente las motivaciones políticas y culturales del terrorismo ni establece herramientas efectivas para prevenir y combatir esta amenaza de forma integral. También se cuestiona su alineación con otras normativas internacionales y se advierte que las imprecisiones podrían limitar su eficacia y poner en riesgo derechos fundamentales. En conclusión, se subraya la necesidad de una arquitectura legal robusta que proteja al país frente al terrorismo.
