The Chilean anti-terrorism law: Critical analysis in light of security

Abstract

The objective of this paper is to critically analyze the Chilean Anti-Terrorism Law in light of contemporary security challenges, identifying its advances, limitations, and risks. Although the reforms enacted in 2024 represent progress, ambiguities persist in the definition of terrorism, as does a predominantly reactive rather than preventive approach, and there remains a lack of clarity regarding the roles of the armed forces and law-enforcement agencies. Likewise, the law does not sufficiently address the political and cultural motivations of terrorism, nor does it establish effective tools to prevent and combat this threat in a comprehensive manner. Its alignment with international norms is also open to question, and the imprecision present may limit its effectiveness and jeopardize fundamental rights. In conclusion, the analysis underscores the need for a robust legal architecture to safeguard the country against terrorism.
