Abstract

To know how to deal with the ethnic/cultural burden inside a mediation process is without any doubt a debt in the current family me-diation design in Chile. There is not public offer that treat this cases in an appropriate way, neither exist any offer from the Justice Ministry in the last tender rules to the family mediation services hiring, any consideration about to demand to the family mediators who live in the region that has the major native population, specific knowledge related to that topic it is quite worrying If we consider that exist a government obligation in this matter according to was exposed in the Agreement 169 of International Job Organization about native tribal people into independent countries, ratified for Chile in September 15th, 2008. This work propose to install the topic in an academic debate, thinking about their necessity and working on ways of intervention from family mediators when they face cases in which one or both of them belong to a native people specially mapuche people.
