From the discussion on hierarchy of international treaties to the idea of constitutional pluralism

This paper reviews the debate on the hierarchy of international
treaties and the Constitutional Court’s position on the issue, noting that regardless of its official position it is actually using international treaties in
its judgments. In the environment of interdependence of the domestic and
international sources of law the application of the international treaties is
becoming more common. This may be understood in light of the concept of
constitutional pluralism as a way of overcoming the discussion of the imposing
hierarchy of international treaties over the human rights.
