THE “CONSTITUTIONAL REITERPRETATION” OF AWARENESS APPRECIATION ON THE SPANISH CRIMINAL PROCEDURE LAW

Abstract

This article is focused on the analysis of the different evidence evaluation sys-tems in the criminal trial, with special attention to the correct interpretation, within a constitutional model of fair trial, of the “apreciación en conciencia” (appreciation in conscience) or “íntima convicción” (intimate belie f) prin-ciple estabilished in the Spanish code of Criminal Procedure.
