SOME REFLECTIONIS IT BRINGS OVER OF THE “GUARDINSHIP MANDAMENTAOL” IN THE CIVIL SPANISH PROCESS

Abstract

This article is focused on claiming the acknowledgement and regulation in the Spanish civil trial of the so-called “tutela mandamental” (“mandate pro-tection”), against what happens nowadays. This relies on the fact that the “mandate judgements and actions” form, no doubt, an excellent instrument aimed at achieving a more effective civil trial, clearly observing the funda-mental right to the actual judicial protection.
